Sony BMG Settles Anti-Piracy Software Suit

Sony BMG has agreed to pay $1.5 million in costs and penalties, and has agreed to reimburse consumers to settle a lawsuit over music CD's that automatically installed hidden anti-piracy programs onto consumer's computers.

The suit, filed in Texas and California, alleges that Sony BMG failed to disclose that CD's were loaded with either the MediaMax or XCP copy-protection software.  In addition, some computers were damaged when attempting to remove the software.  Each state will receive $750,000 in civil penalties and consumers who qualify in those states can receive up to $175 in refunds.  The settlement also forces Sony BMG to improve it's disclosure practices, and to halt distribution of CDs loaded with anti-piracy software that can not be easily removed for a consumer's computer.

Customers have up to 180 days to file a claim, which must include a description of the damage and documentation of repair expenses.   Over 500,000  CD's were thought to carry the software in Texas and California.

Wicked, the Broadway musical and theatrical tour was the top "Most Requested Event" in 2006 according to Ticketmaster, the world's leading ticketing company. Following closely behind on the chart ranked by online page views, information requests, and ticket sales from 1/1/06 to 12/13/06 were Jimmy Buffett and Tim McGraw and Faith Hill's Soul2Soul II Tour.

Jimmy Buffett and McGraw/Hill's tour were also the top two "Most Requested Concerts" of 2006, followed by Dave Matthews Band and the Cheetah Girls ranking at #3 and #4 respectively. Wicked also ranked as the #1 "Most Requested Arts and Theatre Event" followed by IL Divo, Mary Poppins, and Blue Man Group. The New England Patriots, Chicago Bears, and New York Yankees were Ticketmaster's "Most Requested Sporting Events" in 2006. And Disney On Ice followed by Ringling Bros. and Barnum & Bailey Circus, Radio City Christmas Spectacular, and the Wiggles were the year's "Most Requested Family Attractions."

"It's wonderful to see every category of live entertainment represented among the year's most requested events," said Ticketmaster President, Sean Moriarty. "Fans have never had a greater opportunity to choose from such a wide set of live events and, based upon the choices they're making, they clearly like what they see."

Kenny Reaches for Another ‘Beer In Mexico’

Kenny Chesney might like a frosty cold beer now and then, but he's never been fond of the cold temperatures that come with winter growing up in the Smoky Mountains. So, it makes sense that the next single from the reigning Country Music Association and back-to-back Academy of Country Music Entertainer of the Year's triple platinum The Road & The Radio is the feverpitched, tropically-drenched "Beer In Mexico," a song destined to hear things up even when the mercury drops.

"That song just feels so good," Chesney enthuses. "At this time of year, I think we all could use a song that makes our blood run a little quicker, our laugh a little louder and, well, you driving be just a little faster… and I think that's what 'Beer In Mexico' is all about."

The driving a little faster part is certainly not lost in the creation. The song's genesis — almost three years ago — may come from a decidedly quiet moment, but that quiet moment was spent kicked back at Sammy Hagar's pool in Mexico, where Chesney and his band had gone to play at the Red Rocker's Birthday Bash.

"Everybody'd gone off fishing, I think," Chesney says with a laugh, "and I just decided to stay behind. I didn't even know why — until suddenly this song started coming to me. Just literally, right there at Sammy's pool… WHAM… here comes this song, which is how it happens sometimes.

"After all, if you listen to the lyrics, there really is no better place to inspire them. You're kicked back, taking it easy, watching the sun move across the sky… In moments like that, you actually realize that you don't always have to do something, make that decision, you can just have another cold beer, enjoy the day and let yourself breathe."

With it's percolating rhythms and punctuating brass section, "Beer In Mexico" takes Chesney's island drift in a whole new direction. But one doesn't need a compass to figure out which way to go for his always free'n'easy good time… though winter is upon us, Chesney still believes in musical cures, and The Road & The Radio has plenty of songs — including the multiple week #1s "Living In Fast Forward" and "Summertime," as well as the sweeping balladry of "Who You'd Be Today" and "You Save Me." — has plenty of songs that will heat fans up from the inside out.

"You know, we were talking about a bunch of options, but the more I thought about it, the more I felt what time of year it is, this is obvious! We need something to kick us out of the winter doldrums on our way to work or whatever. I know what kind of songs I like to hear right about now, so I figured that's the best choice possible… and that it reminds me of such a great time me and the guys had, well, that's just a bonus!"

USA Today Visit Trace Adkins

Wreckers, Big & Rich Perform During NHL All-Star Activities

The Wreckers, Big & Rich, Trisha Yearwood, and Garth Brooks are among those scheduled to appear during the National Hockey League's All-Star Celebration taking place Jan. 20-24 in Dallas. The Wreckers will sing the national anthem prior to the all-star game on Jan. 24 at the American Airlines Center and will also perform during the intermission. Big & Rich will headline a private party sponsored by the NHL on Jan. 23 at Gilley's club. Yearwood will perform during a concert benefiting Brooks' Teammates for Kids charity. Brooks will host the event taking place April 22 at the Hyatt Regency.

After celebrating yet another year of multi-platinum success with his latest release, White Trash With Money, country superstar Toby Keith's Ford Trucks-sponsored "Hookin' Up & Hangin' Out Tour" is set to roll into 2007 with newly announced opening acts Miranda Lambert and Flynnville Train.

The 2007 leg of the tour kicks off January 25 goes on until February 10 (see itinerary below). With his first feature film, Broken Bridges, "airing" as in-flight entertainment on airlines worldwide and making its television debut on Dec. 15 on CMT, Keith has achieved a new level of career success with unprecedented visibility on radio, onscreen and on the road. True to form, even in the midst of a burgeoning acting career, Keith's musical and commercial instincts never let him down. The Keith-produced soundtrack to Broken Bridges was the highest charting country soundtrack debut in SoundScan history.
